In unincorporated Palm Beach County, the Unified Land Development Code allows a guest cottage. It defines one as accessory sleeping quarters for non-paying guests of the owner. A guest cottage is permitted by right next to a single-family home, townhouse or zero lot line home.

The code sets clear limits:

  • A maximum of 800 square feet on lots under one acre, or 1,000 square feet on one acre or more.
  • No kitchen facilities.
  • No separate utility meters. It must share utilities with the main home.
  • It must match the main home's architecture and materials.

A guest cottage and an accessory dwelling unit (ADU) are not the same thing. Under Florida Statute 163.31771, an ADU has its own kitchen, bathroom and sleeping area. Local governments may allow ADUs in single-family zones, and the state law ties approval under it to an affidavit that the unit will be rented at an affordable rate. Local codes then set their own size and design rules. So if you want a kitchen in the casita, you are likely in ADU territory, with a different set of rules.

Short-term rental limits for guest spaces

Some owners hope to rent the casita when family is not visiting. Before you count on that income, read the rules. Under Florida Statute 509.013, a unit rented to guests more than three times a year for under 30 days, or advertised that way, is a transient public lodging establishment. That brings state licensing through the Department of Business and Professional Regulation and tax collection.

State law also limits local control. Under Florida Statute 509.032, a local law may not ban vacation rentals or regulate how long or how often they are rented, unless the rule was adopted on or before June 1, 2011. However, cities can still regulate other things, and HOA and condo rules can ban short stays outright. Also, the county guest cottage rule describes quarters for non-paying guests.
