An inherited home in Boynton Beach usually falls into one of two worlds. West of I-95, many estates hold a villa or condo in a 55+ community with age rules and buyer approvals. East of I-95, the home is often an older single-family house near a downtown that is still being rebuilt. The legal steps are the same on both sides. The buyers, the paperwork and the pricing are not. This guide covers each piece for heirs.

Two markets for an inherited home in Boynton Beach
The west side holds a large share of the area's adult communities. The east side is older. Streets near Federal Highway and the Intracoastal hold many smaller single-family homes and older condos. That is also where the city has spent years on its Town Square, a $250 million project covering four blocks. The civic buildings opened first, while the private shops and homes stalled for years before the city's redevelopment agency brought in a new developer in 2025.

Who has authority to sell
A buyer's title company will want proof that the person signing has the right to sell. That proof depends on how the owner held title, so get a copy of the deed from the county's official records first.
- Revocable trust. The successor trustee can usually sell without probate. The Florida Bar notes that creditors of a trust-only estate may have up to 2 years to bring claims, so trustees should plan with that in mind.
- Survivorship. A spouse who held the home as tenants by the entirety, or a joint owner with right of survivorship, becomes the sole owner. A recorded death certificate is often the main step.
- Sole name. Someone usually must open probate. The court then appoints a personal representative to act for the estate.
If a personal representative is selling, check the will. Under section 733.613 of the Florida Statutes, a will that grants a power to sell real property lets the representative sell without a court order. Without that language, the court has to approve the sale.
Probate for an inherited home in Boynton Beach
Boynton Beach estates are handled by the Fifteenth Judicial Circuit in Palm Beach County. To begin, whoever has the original will must file it with the clerk within 10 days after learning of the death, under section 732.901.
There are two main paths. Formal administration is the full process. Summary administration is faster and, under section 735.201, can apply when the estate subject to administration, minus exempt property, is $150,000 or less, or when the owner died more than 2 years ago.
The Florida Bar estimates about five or six months for a simple estate. It must stay open at least through the three-month creditor period, and selling real estate can add time. Homestead limits on an inherited home in Boynton Beach
A Florida homestead follows its own rules. Under section 732.4015, an owner who leaves a spouse or a minor child cannot simply leave the homestead to someone else in a will. If the home passes under section 732.401, the spouse gets a life estate and the descendants get the remainder. The spouse may instead elect a one-half share as a tenant in common, but the election must be made within 6 months after the death.
These rules can add names to the deed. Many title companies also ask for a court order confirming homestead status before they insure a sale, even when the owner left no spouse or minor child. Raise this with your attorney at the first meeting.
Taxes shift too. The homestead exemption and Save Our Homes cap end with the change in ownership, so later bills can rise toward full market value. That matters if heirs plan to hold the home for a while.
Selling an inherited 55+ villa or condo
Federal fair housing rules let a community qualify as housing for older persons if at least 80% of occupied units have at least one resident who is 55 or older, among other conditions. To protect that status, many associations limit who can live in a unit and may restrict rentals. In addition, some require the association to approve a buyer before closing.
For heirs, this has real effects. A younger heir may not be able to move in or lease the unit as planned. Meanwhile, the condo dues keep coming. So before you decide to keep or sell, ask the association for:
- The governing documents, rules and any age verification policy.
- The buyer approval process and how long it takes.
- An estoppel certificate showing dues and any assessments owed.
- Recent financial records, which a resale buyer can request under section 718.503.
Then price with the market in mind. Miami Realtors reported 130 condo and townhouse sales in the city in Q4 2025, at a median of $225,000. Those units took a median of 67 days to go under contract, and sellers received 90.9% of their original list price. Supply stood at 9.3 months, so buyers had plenty to choose from. An inherited villa priced above similar units in the same community will likely wait.
Selling an inherited east-side house
Single-family homes moved faster. In Q4 2025, the city recorded 159 house sales at a median of $440,000. Those homes went under contract in a median of 46 days, sellers received 94.6% of their original list price, and supply was 3.6 months.
Many inherited east-side houses are older and have been in one family for decades. Roofs, plumbing and electrical panels may be original. Still, buyers often pay for the lot and the location near the beach and the changing downtown. So do not price the house as if its condition were the only factor. Cleanout, repairs and current listings
Work through the belongings in order. Start with documents like deeds, tax returns and insurance policies. After that, let relatives pick keepsakes and record who took what. Have anything valuable appraised. Then hire an estate sale company or a hauling crew for the rest. Keep receipts, since the estate often covers these costs.
