The deed lists only the person who died
Then someone usually must open probate. The court names a personal representative, the Florida term for an executor. Under section 733.613 of the Florida Statutes, a personal representative can sell without a court order if the will grants a power of sale. Without that power, they need the court's approval first.

Florida has two main types of probate. Formal administration is the full process. The Florida Bar says creditors generally have three months to file claims after the notice runs. Because of that window, it expects a simple probate to take about five or six months. The Bar also advises every personal representative to hire a qualified attorney.

Homestead rules that can change who inherits
Florida protects a homestead in ways that surprise many heirs. If the house was the owner's primary residence, a few questions matter.
Did the owner leave a spouse or a minor child?
Under section 732.4015, an owner survived by a spouse or a minor child cannot freely leave the homestead to someone else by will. The one exception lets the owner leave it to the spouse when there is no minor child.
If the home did not pass under a valid will, section 732.401 applies. The spouse gets a life estate, and the children get the rest. Instead, the spouse can choose a one-half share as a tenant in common. That election must be made within six months after the death, and it cannot be undone. These rules can add signers to the deed, so talk with an attorney before you list.
What happens to the tax break?
The owner's homestead exemption and Save Our Homes cap end with the change of ownership. Then the home is taxed at full market value on a later roll, unless a new owner qualifies and applies. In a long-held house, that jump can be large. As a result, many heirs decide to sell rather than hold.
