Only the legal owner, or a person with legal authority, can sign a deed. After a death, that depends on how the home was held. So the first task is to find the deed. You can search the Palm Beach County Clerk's official records, or a title company can pull it for you.
The home is in a revocable trust
Many owners plan ahead with a living trust. If the home was deeded to the trust, the successor trustee named in it can usually sell. In most cases no probate is needed for that home. Even so, the title company will ask for the trust papers and a death certificate.

Next comes the type of case. Formal administration is the full process. Summary administration is shorter. Under section 735.201, it can apply when the estate subject to administration, minus property exempt from creditors, is worth $150,000 or less, or when the person died more than 2 years ago.
Timing depends on the facts. The Florida Bar says a simple estate takes about five or six months, and the estate must stay open at least through the three-month creditor claim period. Was there a surviving spouse or a minor child?
Under section 732.4015, an owner who leaves a spouse or a minor child cannot freely leave the homestead to someone else by will. If the home passes under section 732.401 instead, the spouse gets a life estate and the descendants get the remainder. The spouse may instead elect a one-half interest as a tenant in common. That election must be made within 6 months after the death. In either case, more people may need to sign the deed.
Was the owner the last to die?

Those homes went under contract in a median of 42 days, and sellers received 94.5% of their original list price. Half of them, 7 of 14, were paid in cash. Meanwhile, only 4 condos and villas sold, at a median of $292,500. With 12 active condo listings, supply stood at 16.0 months.
According to Pure Equity's MLS data as of October 1, 2026, Atlantis had 41 active residential listings. The median list price was $284,000, and the median list price per square foot was $193.
