Palm Beach County probate runs through the Fifteenth Judicial Circuit. Summary administration only applies when the estate subject to probate, minus exempt property, is $150,000 or less, or when the death was more than two years ago. So a Manalapan estate in probate will almost always use formal administration.

The Florida Bar says creditors generally have three months to file claims after notice. Because of that, even a simple estate takes about five or six months. It also says the personal representative should always hire a qualified attorney.

Federal estate tax deserves early attention. The IRS sets the basic exclusion at $15,000,000 for people who die in 2026. The gross estate includes real estate, securities, insurance and business interests at their value on the date of death. If the home was the owner's primary residence, Florida homestead rules apply. Under section 732.4015, an owner survived by a spouse or a minor child cannot leave the homestead to someone else by will. The exception allows a gift to the spouse when there is no minor child.

When no valid will controls, section 732.401 gives the spouse a life estate and the children the remainder. Instead, the spouse may elect a one-half share as a tenant in common within six months after the death. That choice is final once recorded.

Trusts do not escape these limits. The statute treats a trust grantor's homestead interest as if the grantor owned it directly. So even a trust sale may need a homestead review. Also, the homestead exemption and Save Our Homes cap end when ownership changes, which can raise a later tax bill sharply on a long-held estate.

Coastal disclosures when you sell an inherited house in Manalapan

Coastal estates carry an extra state rule. If the property sits partly or fully seaward of the coastal construction control line, section 161.57 requires a written disclosure at or before the contract is signed. It tells the buyer the property may face coastal erosion and coastal regulations.
