It incorporated in November 2006, covers about 12.5 square miles and had 3,355 residents in the 2020 census. The Historical Society of Palm Beach County notes that the town is known as "Florida's Last Frontier."

Some rural owners place their land in a revocable living trust. Then the successor trustee can usually sell without probate. The title company will want the trust and a death certificate.

Property held with a survivor

Spouses who owned the land as tenants by the entirety pass it to the survivor automatically. Joint tenants with right of survivorship work the same way. Recording a death certificate is often all that is needed.

Property in the owner's sole name

In this case, someone usually must open probate, and the court names a personal representative. If the will gives a power of sale, section 733.613 of the Florida Statutes lets that person sell without a court order. Without that power, they must get the court's approval.

Probate for a western Palm Beach County estate

Estates here go through the Fifteenth Judicial Circuit, the same court that handles the rest of the county. Florida has two main types of administration.

Summary administration is the short form. It applies when the estate subject to probate, minus exempt property, is worth $150,000 or less, or when the person died more than two years ago. Land here is rarely worth that little. So most families use the full process unless two years have passed.

The Florida Bar says creditors generally have three months to file claims after notice. As a result, it expects even a simple estate to take about five or six months. It also says the personal representative should always hire a qualified attorney.

Homestead rules on acreage you plan to sell

Florida's homestead protections apply to an owner's primary residence. They can override a will when the owner left a spouse or a minor child.

Under section 732.4015, such an owner cannot leave the homestead to anyone else, except to the spouse when there is no minor child. If no valid will controls, section 732.401 gives the spouse a life estate and the children the rest. Instead, the spouse may elect a one-half share as a tenant in common within six months after the death.

Acreage raises one more question. Florida's constitution limits how much land outside a city counts as homestead, so part of a large parcel may fall outside the protection. That is a question for your attorney, and it can affect who must sign. Also remember that the homestead exemption and Save Our Homes cap end with the change of ownership.

Farm tax status and income taxes

Many Loxahatchee parcels have a farm tax status, called agricultural classification. It can lower the taxable value. However, it does not pass to a buyer or heir on its own.

According to the Palm Beach County Property Appraiser, if the prior owner qualified as of January 1, the classification stays for the rest of that tax year. After that, a new owner must reapply between January 1 and March 1. They must show bona fide commercial agricultural use as of January 1. Buyers will factor this in, so tell them early.

Heirs also usually get a stepped-up basis. Under IRS rules, the basis of inherited property is generally its fair market value on the date of death. The median asking price per square foot was $337, and active listings had been on the market for an average of 144 days. Those are asking prices for homes still for sale, not closed sales.
