Start with recent resales in your own community. A home in one club can differ in price from a similar home in the next club over, because dues, amenities and membership rules differ. Then look at what builders are asking for new homes nearby, and at any incentives they offer. A licensed appraiser and the Palm Beach County Property Appraiser's sale records give you two more checks.

Gather your HOA and club documents

Buyers will ask about dues, special assessments, rules on rentals and pets, and any club membership terms. Some communities have their own approval or membership steps. So pull your governing documents, your latest budget and any club papers before you list. Then request an estoppel letter early, since the contract usually assigns that fee to the seller.

Plan for gate access

In a gated community, every showing needs a way in. Check how your gatehouse handles guests and vendors, and set it up before the listing goes live. Otherwise, buyers and photographers may get stuck at the gate.

Use a standard Florida contract

Most sales use a Florida Realtors and Florida Bar form. The "As Is" version gives the buyer an inspection period, 15 days if the blank is left empty, with the right to cancel in that time. It also lists seller costs such as deed stamps and HOA or condo estoppel fees. Have a title company or attorney ready before you accept an offer.

Disclosures for a FSBO in Palm Beach Gardens

Florida has no single required seller form. Instead, the duty to disclose comes from case law and statutes. In Johnson v. Davis (1985), the Florida Supreme Court held that a seller must disclose known facts that materially affect value and that a buyer cannot readily see. Next, add these items:

  • HOA disclosure summary. Section 720.401 requires a summary for most homes in a mandatory HOA. It covers membership, covenants, assessments and possible liens. If the buyer gets it after signing, they can cancel within 3 days of receiving it or before closing, whichever comes first.
  • Flood disclosure. Section 689.302 requires it at or before contract signing. It covers known flood damage while you owned the home, flood claims and flood aid.
  • Property tax summary. Section 689.261 warns buyers not to rely on your current taxes, since a sale can reset the assessment.
  • Radon notice. Section 404.056 requires a short radon statement on at least one sale document.
  • Condo documents. For a condo, section 718.503 lists the papers you must provide and gives the buyer a 7-day cancel window.

If the home was built before 1978, federal rules also require a lead paint disclosure and a 10-day testing window.

Buyer's agent pay in a FSBO sale

Most buyers in this price range work with an agent. Under the NAR settlement rules in effect since August 17, 2024, offers of pay to a buyer's broker cannot appear on the MLS. Buyers must also sign a written agreement with their agent before touring, which sets that agent's pay.

Sellers still have options. You can agree to pay the buyer's broker off the MLS using Rider GG. You can offer the buyer a credit with Rider FF. Or you can decline and let buyers pay their own agents.
