A flat fee MLS service lists the home through a broker for a set fee while you keep control. In the description, name the community, the school zones and nearby parks. Set clear showing hours and ask callers whether they have a loan approval. When offers come in, compare more than price. Look at the deposit, the loan type, the inspection period and the closing date.
Florida contracts and disclosures for a FSBO in Royal Palm Beach
Most Florida sales use contract forms made by Florida Realtors and The Florida Bar, including an AS IS version. A real estate attorney can fill one out and review the buyer's changes. That fee is small next to the cost of a bad contract.
Next, plan your disclosures. Florida law and courts require these:
- Hidden defects you know about. Johnson v. Davis (1985) says a seller must disclose known facts that materially affect value and are not easy to see.
- Flood history. Section 689.302 requires a flood disclosure at or before signing. It covers flood damage, flood insurance claims and federal aid such as FEMA help.
- Property taxes. Section 689.261 requires a notice that the buyer's taxes may rise after the sale.
- Radon. Section 404.056(5) requires a radon notice in the contract.
- Lead paint. Homes built before 1978 need the federal lead disclosure form.
HOA paperwork for a FSBO in Royal Palm Beach
This is where many owners in the village slip. Under section 720.401, a buyer in an HOA community must get a disclosure summary before signing the contract. If it is missing, the buyer can cancel within 3 days after receiving it or before closing, whichever comes first. That right cannot be waived.
The association will also issue an estoppel certificate under section 720.30851. It shows any dues, fees or fines still owed on the home. The title company orders it. Your contract says who pays the fee, so read that line before you sign. Ask for it early, since a surprise fine can delay closing.
Finally, collect the rules, the budget and any notice of a special assessment. Families like to know what they are signing up for. Clear answers keep a deal together.
Buyer's agents and the 2024 settlement
Since August 17, 2024, pay offers to buyer's brokers cannot be posted on the MLS. Agents working with buyers need a written agreement before they tour a home. NAR's own FAQ notes that compensation "is fully negotiable."

Here is an example for a typical three-bedroom HOA home. The figures are for illustration, not a forecast.
- FSBO path: the home sells for $485,000. You pay your own costs above, with no listing fee.
- Agent path: the home sells for $505,000. You pay the same costs plus your negotiated listing commission of X%.
The test is simple. Subtract the FSBO price from the agent price. Here the difference is $20,000. If your total commission is less than that, the agent path leaves you more money. If the agent cannot get a higher price, FSBO wins.
So the key question for any agent is how they would reach the higher price. Ask for their recent sales in your community and their plan for marketing.
When a listing agent is worth it here
An agent often pays for themselves when:
- Your model has many similar homes for sale, so you need sharper pricing and marketing.
- Your HOA has a buyer approval process or open violations to clear.
- You are relocating and cannot be home for showings.
