Selling an inherited or probate home in West Palm Beach
Selling an inherited or probate home in West Palm Beach depends heavily on what you inherited. 1,079 of the city's active listings are condominiums and 509 sit in buildings of three storeys or more, where the building's structural position matters as much as the court's timetable.

Every situation on this page comes down to a number: what the property is worth and what you would net. We will work both out from recent sales near you, at no cost.
An inherited condominium is a different problem
1,079 of the 2,207 active listings here are condominiums, more than the 770 single-family homes.
509 active listings are in buildings of three storeys or more, the largest count in the county.
72% of the city's stock predates 2000, so many of those buildings are in scope for Florida's structural requirements.
That means an inherited condominium carries a question the estate cannot answer or control: the building's position.
Fla. Stat. 553.899 requires a milestone inspection of certain buildings of that height once they reach a statutory age.
Fla. Stat. 718.112 requires a structural integrity reserve study and restricts waiving the reserves it identifies.
None of what follows is legal or tax advice, and the sections below say plainly where you need a professional.
The first question: who can actually sign
A deed can only be signed by someone with legal authority to convey the property.
Where the property is in an estate, that is usually the personal representative, appointed by the court.
Florida probate administration sits under Fla. Stat. Chapter 733, and a summary procedure exists for smaller estates or where death occurred more than two years earlier.
Whether the personal representative can sell without a specific court order depends on the will and on the powers granted.
A title company will want to see the letters of administration before closing, so this is not optional.
Ask a Florida probate attorney what authority exists and what is still needed, before you list rather than after.
Listing a property nobody has authority to convey wastes months in a market where buyers have 2,207 alternatives.
Homestead, which can sit outside the estate
Florida homestead property carries constitutional protections and devise restrictions under Art. X, s.4 of the Florida Constitution.
Where there is a surviving spouse or a minor child, those restrictions limit how the property can be left by will.
Homestead can pass outside the probate estate, directly to the heirs the constitution specifies.
That changes who has to sign a deed, and it is a frequent source of delay when it is discovered late.
It applies to a condominium that was the owner's homestead just as it does to a house.
This is precisely the part a probate attorney resolves, and it is worth resolving before marketing.
We raise it because it surprises heirs constantly, not because we can answer it for you.
The tax point most heirs do not know
Inherited property takes a basis stepped up to fair market value at the date of death, under IRC 1014.
In plain terms, the gain that accrued during the deceased owner's lifetime is generally not taxed to the heir.
On a property held here for decades, that is frequently the largest single financial fact in the transaction.
It means an heir selling shortly after inheriting often has little or no taxable gain.
Florida has no state estate tax and no inheritance tax, which removes a layer that exists in other states.
None of that is advice and the details depend on facts we do not have, so a CPA should confirm it.
But it is worth knowing before assuming a sale will produce a large tax bill, because frequently it does not.
The building documents an estate has to obtain
The governing documents, the current budget, the most recent reserve study and a year of board minutes.
Any milestone inspection report and the association's response to it.
A written account statement, because dues accrue during probate and arrears are common.
The association's written position on any pending or contemplated special assessment.
The leasing rules, because they decide whether an investor can buy from the estate.
The approval procedure, which for an estate sale may require documentation of the representative's authority.
Order all of it early, because in a market with 1,079 competing condominium listings a documented building is a differentiator.
Disclosure when you never lived there
Florida law requires a seller to disclose known material defects affecting value, following Johnson v. Davis, 480 So. 2d 625 (Fla. 1985).
That duty attaches to what you know, and a personal representative who never lived in the property may genuinely know very little.
That is a real position rather than a convenient one, and it should be stated plainly to buyers.
It is not a reason to avoid finding out: an inspection tells you what to disclose and what to price.
For a condominium, what the association knows about the building is a separate matter from what you know about the unit.
With 72% of the city's housing predating 2000, there will usually be something to find in either.
Buyers accept limited seller knowledge on an estate sale far more readily than they accept vagueness.
Sell or let, and why the question is live here
2,210 rental listings are active in West Palm Beach at a $2,250 median, the deepest rental market in the county.
So heirs here genuinely can let a property rather than sell it, which is not true everywhere.
Whether they can depends on the association's leasing rules, which may impose minimum terms or annual caps.
It also depends on whether the estate can hold the property, which is a question for the attorney rather than us.
Holding carries dues, insurance, taxes, maintenance and vacancy risk, and on an older building an assessment risk too.
Letting also postpones the step-up advantage of selling shortly after inheriting, which a CPA should weigh.
The point is that it is a real choice here, and worth costing properly rather than dismissing.
Property taxes change for the buyer
The deceased owner's homestead exemption and their assessment cap do not survive the transfer.
So the buyer's tax bill will be calculated differently from the one the property has been paying.
That gap can be large on a property held for decades, and buyers notice it.
It is worth having the figure available rather than letting a buyer discover it and recalculate their offer.
In a market with 2,207 competing listings, a late renegotiation can cost you the buyer entirely.
Where the estate has been paying the old capped amount, that is not what a buyer inherits.
Presenting this honestly avoids a renegotiation at the worst possible moment.
How we would handle it
Establish who has authority to sign before anything is marketed, and say so if the answer is nobody yet.
Recommend a Florida probate attorney if one is not already involved, because the authority question is theirs.
For a condominium, establish the milestone and reserve position in writing before anything else.
Order the full document set early and use a clean, documented building as active selling material.
Get the arrears position in writing, because dues accrue through probate.
Price from closed sales in your own building or neighbourhood, honestly as a property in estate condition.
Ask us for a valuation and a realistic timeline, and we will tell you what has to happen before either matters.

Frequently Asked Questions
- Is an inherited condo different from an inherited house?
- Materially, in this city. 509 active listings sit in buildings of three storeys or more and 72% of the city's stock predates 2000, so an inherited condominium carries a question the estate cannot control: the building's milestone and reserve position.
- Can I sell before probate is finished?
- Sometimes, depending on the authority the personal representative holds and what the will provides. Florida probate administration sits under Fla. Stat. Chapter 733, and a title company will want the letters of administration before closing.
- Who signs the deed?
- Whoever has legal authority to convey, usually the court-appointed personal representative. But Florida homestead can pass outside the probate estate under Art. X, s.4 of the constitution, and that applies to a condominium as much as a house.
- Will I owe capital gains tax?
- Often little or none. Inherited property takes a basis stepped up to fair market value at the date of death under IRC 1014, so the gain accrued during the owner's lifetime is generally not taxed to the heir. Confirm with a CPA.
- What building documents does the estate need?
- Governing documents, current budget, most recent reserve study, a year of board minutes, any milestone inspection report and the association's response, a written account statement, the assessment position and the leasing rules.
- Should the estate let the property instead of selling?
- It is a real option here, unlike in much of the county: 2,210 active rental listings at a $2,250 median make this the deepest rental market in Palm Beach County. Whether you can depends on the leasing rules and on what the estate may do.
- What are the downsides of letting instead?
- Dues, insurance, taxes, maintenance and vacancy risk, plus assessment risk in an older building. It also postpones the advantage of selling shortly after inheriting, when the stepped-up basis means little or no taxable gain. A CPA should weigh that.
- What do I have to disclose if I never lived there?
- What you actually know. The duty from Johnson v. Davis attaches to the seller's knowledge, which for a personal representative may be very little. For a condominium, what the association knows about the building is a separate matter from what you know.
- Will the buyer's property taxes be the same as ours?
- No. The homestead exemption and assessment cap do not survive the transfer. In a market with 2,207 competing listings, a late renegotiation over that can cost you the buyer, so have the figure available rather than letting them discover it.
- How long will the whole process take?
- The property part is predictable: sold listings here averaged 50 days to an accepted offer, plus contract and board approval. The probate part depends on the estate, which is why the authority question belongs first rather than last.
